    Risperdal Timeline Facts

    In 1993, the atypical antipsychotic drug Risperdal was first approved by the FDA to treat schizophrenia.

    In 2003, it was approved for usage by adults for the short-term treatment of bipolar I disorder.

    In 2006, Risperdal was approved to treat autism spectrum disorders in children ages 5 to 15.

    In 2007, the FDA approved the use of Risperdal for short-term treatment of schizophrenia in teens age 13 to 17.

    In 2007, the FDA also approved the use of Risperdal for the short-term treatment of bipolar I disorder in children and teens, between the ages of 10 to 17.

    In 2012, Johnson & Johnson settled a lawsuit alleging they illegally promoted off-label uses of Risperdal in children. They paid $181 million.

    In 2012, a judge ordered Johnson & Johnson to pay $1.2 billion in fines for improperly marketing the drug to children.

    Risperdal Lawsuit Verdicts

    Whistleblowers Receive Millions of Dollars in Settlements

    Informants who helped federal, state and local governments file lawsuits against Johnson and Johnson received millions of dollars in settlements. The U.S. prosecutors alleged that Johnson and Johnson encouraged physicians to prescribe Risperdal for uses beyond what the product was designed and approved for. They further alleged that Johnson and Johnson provided kickbacks to doctors who prescribed the drug. The U.S. and local governments alleged that they overpaid through Medicare and Medicaid due to these alleged illegal activities. Two informants received $28 million. Another informant named Allen Jones received $20.3 million when Johnson and Johnson paid $158 million to settle lawsuits brought by the State of Texas.

    Johnson and Johnson Settles Risperdal Lawsuit on the First Day of Trial

    The Plaintiff, 21-year-old Aron Banks, alleged that he took Risperdal as a 9-year-old child from 1999-2004 when the drug had not been approved for use in children. Banks alleged that he suffered severe psychological and emotional trauma after the medication caused him to grow large breasts and developed the condition called gynecomastia. The lawsuit alleged that there are boys that grew breast as large as “D” cups. This was a major design defect of the drug that the judge would have allowed the plaintiff to pursue. The amount of the settlement that was quickly reached during the first day of trial was kept “confidential”.

    Johnson and Johnson Pays $2.2 Billion to Settle Risperdal Lawsuits

    The agreement represents one of the largest settlements in United States history involving the fraudulent marketing of antipsychotic prescription drugs to patients. Johnson and Johnson allegedly improperly marketed Risperdal for uses, which were not approved as safe by the FDA. It was further alleged that Johnson and Johnson paid kickbacks to doctors for writing more and more prescriptions. The lawsuit alleged that Johnson and Johnson illegally marketed and promoted Risperdal to the elderly, children, and people with developmental challenges, while ignoring the health risks of the drugs.

    Arkansas Judge Levies $1.1 Billion Fine Against Johnson and Johnson

    The State of Arkansas sued Johnson and Johnson and its subsidiary in 2007 over the alleged Risperdal abuses. Arkansas Judge Tim Fox found approximately 240,000 violations of Arkansas Medicaid-Fraud Law involving Risperdal. For each violation Johnson and Johnson received a $5,000 fine, which brought the total penalty to more than $1.1 Billion. The judge also issued an $11 million fine for more than 4,500 violations under the Arkansas Deceptive Practices Act. Jurors deliberated for 3 hours and found that Johnson and Johnson and its subsidiary lied about the potentially deadly side effects of Risperdal.
